Welcome to Weathercraft.

The terms “we”, “us” and “our” refer to Jones Ridge Pty Ltd ACN 614 116 004, trading as Weathercraft Wines and Elemental Wines.

Weathercraft operates this website and online store, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience. Our online store is powered by Shopify, which enables us to provide these services to you.

These Terms of Service & Conditions, together with any policies referenced in them, describe your rights and responsibilities when you visit, interact with, purchase from or otherwise use our website, online store and related services.

Please read these Terms carefully, as they include important information about your legal rights, alcohol purchasing requirements, delivery conditions, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our website or services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our website or services.

SECTION 2 — LIQUOR LICENCE AND ALCOHOL SALES

Weathercraft Wines is operated by Jones Ridge Pty Ltd ACN 614 116 004, trading as Weathercraft Wines and Elemental Wines.

Weathercraft Wines holds a Victorian liquor licence number 36151142.

Under our licence, Weathercraft Wines is authorised to supply packaged liquor ordered by mail, telephone, facsimile transmission or internet, and to supply wine produced by us.

The supply of liquor is restricted to wine produced by the licensee.

Internet and electronic orders may be taken at any time on any day through our website, www.weathercraft.com.au.

SECTION 3 — LEGAL DRINKING AGE

You must be at least 18 years of age to purchase alcohol from Weathercraft Wines.

By accessing our website, placing an order, creating an account or otherwise using our services, you represent and warrant that:

1. you are at least 18 years of age;
2. you are legally permitted to purchase alcohol;
3. you are not purchasing alcohol on behalf of a person under 18 years of age; and
4. any person receiving a delivery of wine from us will be at least 18 years of age.

It is an offence to supply alcohol to a person under the age of 18 years, and it is an offence for a person under the age of 18 years to purchase or receive liquor.

Identification may be requested before, during or upon delivery. We may refuse, cancel or refund an order if we reasonably believe that the order has been placed by or on behalf of a person under 18 years of age, or if fulfilling the order would breach liquor licensing laws, delivery requirements or these Terms.

SECTION 4 — ACCESS AND ACCOUNT

To use certain parts of our website or services, including placing an order, joining a wine club, creating an account or accessing customer features, you may be asked to provide information such as your name, email address, billing address, delivery address, phone number, payment information and other relevant details.

You represent and warrant that all information you provide to us is true, accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account details and password. You are responsible for all activity that occurs through your account.

You must not transfer, sell, assign or licence your account to any other person.

We reserve the right to refuse service, close accounts, remove or edit content, cancel orders, or restrict access to our website or services where we reasonably believe there has been a breach of these Terms, misuse of our services, suspected fraud, unlawful conduct or a breach of liquor licensing requirements.

SECTION 5 — OUR PRODUCTS

We make every reasonable effort to provide accurate descriptions, images, tasting notes, vintage details, bottle sizes, alcohol information, prices and availability information for our wines and other products.

However, wine is an agricultural product and may vary by vintage, bottle age, storage conditions, production decisions and availability. Product images, label images, colours and packaging may also appear differently on your device or screen.

We do not warrant that the appearance, colour, packaging or presentation of a product will be exactly the same as shown on the website.

All product descriptions, prices and availability are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

We may limit the quantities of products available for purchase by any person, household, account, address, geographic region or jurisdiction, particularly where wines are limited, allocated, library releases, member releases or small-production wines.

SECTION 6 — ORDERS

When you place an order through our website, you are making an offer to purchase the products in that order.

Weathercraft reserves the right to accept or decline your order for any reason, including where:

1. the product is unavailable;
2. there has been a pricing, description or availability error;
3. payment cannot be processed;
4. we suspect fraud or misuse of our website;
5. we reasonably believe the order may breach liquor licensing laws or delivery requirements;
6. the order appears to be for commercial resale, unauthorised export or another purpose not permitted by these Terms; or
7. delivery cannot be made to the address provided.

Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it. Once an order has been accepted, packed or dispatched, we may not be able to accommodate cancellation or amendment requests.

If we do not accept your order, or if we make a change to or cancel your order, we will attempt to notify you using the email address, billing address or phone number provided at the time the order was placed.

Your purchases are subject to return, refund or exchange only in accordance with our Refund Policy and Shipping & Returns Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale, unauthorised export or supply to any person under 18 years of age.

SECTION 7 — PRICES, GST AND BILLING

All prices are listed in Australian dollars unless otherwise stated.

Unless otherwise stated, prices include GST where applicable.

Prices, discounts, offers and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed and will be shown in your order confirmation.

Shipping, handling and any other delivery charges will be shown at checkout where applicable.

We may offer promotions, discounts, member benefits, bundles or special offers from time to time. These may be subject to separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the specific promotional terms will apply to the extent of the conflict.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made through our website.

You agree to promptly update your account and other information, including your email address, payment details and delivery address, so that we can complete your transactions and contact you as needed.

SECTION 8 — PAYMENT PROVIDER

Payments through our Shopify store are processed using Shopify Payments and/or other payment methods made available through Shopify from time to time.

By placing an order, you authorise the applicable payment provider to process your payment and you agree to comply with the relevant payment provider’s terms and conditions.

We do not store your full credit card details on our own systems. Payment information is processed securely through Shopify and its payment service providers.

You represent and warrant that:

1. the payment information you provide is true, correct and complete;
2. you are authorised to use the payment method provided;
3. charges incurred by you will be honoured by your bank, card issuer or payment provider; and
4. you will pay all charges incurred by you at the prices displayed at checkout, including any applicable shipping, handling and taxes.

SECTION 9 — SHIPPING AND DELIVERY

We currently ship website orders within Australia only.

Customers outside Australia who wish to purchase wine for personal use or consumption may contact us directly at inter-sales@weathercraft.com.au. International orders, where available, are assessed individually and are subject to separate pricing, shipping quotes, customs requirements, import duties, taxes, local laws and legal restrictions. We are not obliged to accept or fulfil any international order enquiry.

Domestic deliveries are usually sent by Australia Post and, in some cases, Aramex or another carrier.

Wine may be delivered to residential addresses, business addresses or PO boxes where accepted by the carrier.

Wine must be delivered to a person aged 18 years or over. Identification may be requested on delivery.

If no person aged 18 years or over is available to receive the delivery, the carrier may leave a collection card, redirect the parcel to a Post Office or parcel collection point, or attempt redelivery depending on the carrier’s process.

During warmer months, we prefer wine not to be left unattended. Our postal fee is intended to cover person-to-person or signature delivery where available.

Customers may provide delivery instructions or authority-to-leave instructions where available. However, wine must not be delivered to or left with a person under 18 years of age.

Where a customer authorises wine to be left unattended, the customer accepts the risk of loss, theft, heat damage or damage after delivery, to the extent permitted by law.

In Victoria, where required by law or carrier process, first-time recipients of wine may be required to sign for the delivery and provide evidence of age.

Liquor must not be delivered and left at unoccupied premises on the same day the order is received.

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, weather, heat events, public holidays, incorrect delivery details, customs processing or events outside our reasonable control.

Shipping rates may change from time to time, including when we update our Shopify shipping configuration.

SECTION 10 — HEAT, WEATHER AND DELIVERY CONDITIONS

Wine is sensitive to heat, sunlight and extreme temperature conditions.

We take reasonable care when packing and dispatching wine. However, once wine is in transit, delivery conditions may be affected by weather, carrier handling, delays, public holidays or other events outside our reasonable control.

During periods of extreme heat or unsuitable delivery conditions, we may delay dispatch to protect the quality of the wine. If this occurs, we will dispatch your order when conditions are more suitable.

If you provide authority to leave wine unattended, you acknowledge that wine may be exposed to heat, sunlight, theft or other damage after delivery, and you accept that risk to the extent permitted by law.

SECTION 11 — RETURNS, REFUNDS AND EXCHANGES

Returns, refunds and exchanges are handled in accordance with our Refund Policy and Shipping & Returns Policy.

Nothing in these Terms excludes, restricts or modifies any consumer rights that cannot be excluded under the Australian Consumer Law or any other applicable law.

If a product is faulty, damaged, incorrectly supplied or otherwise subject to a consumer guarantee under the Australian Consumer Law, you may be entitled to a remedy.

To request a return, refund or exchange, please contact us using the contact details provided on our website and include your order number, contact details, a description of the issue and, where relevant, photographs of the product or packaging.

We may require proof of purchase before assessing a return, refund or exchange request.

SECTION 12 — WINE CLUB, MEMBERSHIPS AND ALLOCATIONS

From time to time, Weathercraft may offer wine club memberships, release allocations, member-only offers, priority access, discounts, special packs, tasting offers or other customer benefits.

Wine club benefits, release timing, minimum purchase requirements, discounts, shipping arrangements, cancellation rights, payment arrangements and member obligations will be set out in the specific wine club terms, offer details or sign-up information available at the time.

Unless expressly stated at sign-up, wine club membership does not create an automatic recurring payment arrangement.

If we introduce automatic recurring payments, subscription billing or scheduled wine club charges in the future, the relevant terms, billing frequency, cancellation process and customer authorisations will be disclosed before sign-up.

We reserve the right to amend, suspend, close or discontinue any wine club, membership tier, benefit, allocation or offer at any time, subject to any rights you may have under applicable law.

Wine club offers are subject to product availability. As a small producer, some wines may be limited, allocated or unavailable.

SECTION 13 — INTELLECTUAL PROPERTY

Our website and services, including but not limited to all trademarks, logos, brands, text, images, graphics, product reviews, tasting notes, video, audio, design, layout, selection and arrangement, are owned by Weathercraft, its affiliates or licensors and are protected by Australian and international intellectual property laws.

These Terms permit you to use our website and services for personal, non-commercial use only.

You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, scrape, copy or otherwise exploit any material on our website without our prior written consent.

Nothing in these Terms grants you any licence or rights in any intellectual property owned by Weathercraft, Shopify or any third party, except as expressly set out in these Terms.

Weathercraft’s names, logos, product names, service names, designs and slogans are trademarks or branding of Weathercraft or its affiliates or licensors. You must not use them without our prior written permission.

Shopify’s name, logo, product names, service names, designs and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs and slogans on our website are the property of their respective owners.

SECTION 14 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, features, applications, payment services, shipping services, analytics tools, review tools, marketing tools, age-verification tools, cookie tools or other services offered by third parties.

We do not control all aspects of these third-party tools and services.

You acknowledge and agree that third-party tools and services may be provided “as is” and “as available”, and that your use of them may be subject to separate third-party terms and privacy policies.

We are not responsible for any loss, damage or issue arising from your use of third-party tools or services except to the extent required by law.

We may also offer new features, tools, resources or services through the website in the future. Those new features will also be subject to these Terms unless separate terms apply.

SECTION 15 — THIRD-PARTY LINKS

Our website may contain links to websites, content, platforms, tools or resources operated by third parties.

We are not responsible for examining or evaluating the content, accuracy, policies, security or practices of third-party websites or services.

If you access third-party websites or services through links on our website, you do so at your own risk.

We are not liable for any harm, loss or damage related to your access to third-party websites or your purchase or use of products, services, resources or content from third parties.

Please review third-party terms, policies and practices before you engage in any transaction with them.

SECTION 16 — RELATIONSHIP WITH SHOPIFY

Weathercraft’s online store is powered by Shopify, which enables us to provide our online store and related services to you.

However, any sales and purchases you make through our store are made directly with Weathercraft.

By using our website and services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Weathercraft, including any injury, damage or loss resulting from products or services purchased from Weathercraft.

To the extent permitted by law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with Weathercraft.

SECTION 17 — PRIVACY POLICY

Personal information collected through our website and services is handled in accordance with our Privacy Policy.

Because our online store is powered by Shopify, Shopify may also collect and process personal information in order to provide and improve the services made available through our website.

Information you submit through our website may be transmitted to, stored by or shared with Shopify and other third-party service providers, including service providers located outside Australia, where necessary to provide our services, process payments, fulfil orders, manage customer accounts, support marketing preferences, improve website functionality or comply with legal obligations.

SECTION 18 — FEEDBACK, REVIEWS AND CUSTOMER CONTENT

If you submit, upload, post, email or otherwise provide reviews, comments, feedback, ideas, suggestions, photographs, testimonials, proposals or other content to us, you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, display and otherwise use that content in any medium for any purpose, including operating, improving and promoting Weathercraft and our services.

You represent and warrant that:

1. you own or have all necessary rights to the content you submit;
2. your content is accurate to the best of your knowledge;
3. your content does not infringe any third-party rights;
4. your content is not unlawful, misleading, defamatory, abusive, obscene or otherwise objectionable; and
5. you have disclosed any compensation, incentive or benefit received in connection with your content.

We may, but are not obliged to, monitor, edit or remove customer content that we determine to be unlawful, offensive, misleading, defamatory, inappropriate, infringing or otherwise in breach of these Terms.

You are solely responsible for any content you submit and its accuracy.

SECTION 19 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our website or in our services that contains typographical errors, inaccuracies or omissions.

These may relate to product descriptions, vintage information, tasting notes, alcohol information, pricing, promotions, offers, shipping charges, transit times, availability or other information.

We reserve the right to correct errors, inaccuracies or omissions, and to change, update or cancel orders if any information is inaccurate at any time, including after you have submitted an order.

We are not obliged to update, amend or clarify information except as required by law.

SECTION 20 — PROHIBITED USES

You may use our website and services for lawful purposes only.

You must not use our website or services:

1. for any unlawful, fraudulent or malicious purpose;
2. to purchase or attempt to purchase alcohol if you are under 18 years of age;
3. to purchase alcohol for, or supply alcohol to, a person under 18 years of age;
4. to breach any applicable law, regulation, rule or ordinance;
5. to infringe or violate our intellectual property rights or the intellectual property rights of others;
6. to harass, abuse, insult, harm, defame, slander, intimidate or discriminate against any person;
7. to submit false or misleading information;
8. to upload or transmit viruses, malware or malicious code;
9. to spam, phish, pharm, pretext, crawl, scrape or interfere with the operation of our website;
10. to collect or track personal information of others;
11. to impersonate any person or entity;
12. to interfere with or circumvent the security features of our website or services;
13. to reproduce, duplicate, copy, sell, resell or exploit any portion of our website or services without our written permission; or
14. to engage in conduct that restricts or inhibits anyone’s use or enjoyment of our website or services, or that may harm Weathercraft, Shopify or users of the website.

We reserve the right to suspend, disable or terminate your account or access to our website at any time, without notice, if we determine that you have violated these Terms.

SECTION 21 — AUTOMATED TOOLS, BOTS AND AGENTS

You must not use any robot, spider, scraper, crawler, data-gathering tool, extraction tool, automated device, artificial intelligence tool, agentic AI system or other automated process to access, copy, monitor, interact with or extract material from our website without our prior written consent.

Any authorised automated tool must identify itself accurately and comply with all technical restrictions, robot exclusion headers, security measures and instructions we provide.

You must not use any automated tool to circumvent access restrictions, complete or bypass CAPTCHAs, mimic human behaviour, overload our systems, interfere with our website or misrepresent the nature of the access.

We may block, limit or restrict automated access at any time.

SECTION 22 — TERMINATION

We may terminate these Terms or suspend, disable or terminate your access to our website or services, in whole or in part, at any time if we reasonably believe you have breached these Terms, misused our services, engaged in unlawful conduct, breached liquor licensing requirements or created risk for Weathercraft, Shopify, our customers or third parties.

You will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy and any other provisions that by their nature should survive termination.

SECTION 23 — DISCLAIMER OF WARRANTIES

The information presented on or through our website and services is made available for general information purposes.

We make reasonable efforts to keep information accurate and current, but we do not warrant the accuracy, completeness or usefulness of all information on the website.

Any reliance you place on information on our website is at your own risk.

Except as expressly stated by Weathercraft or as required by law, our website, services and products are provided “as is” and “as available”, without any representation, warranty or condition of any kind, either express or implied.

We do not guarantee, represent or warrant that your use of our website or services will be uninterrupted, timely, secure or error-free.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot be excluded, restricted or modified under Australian Consumer Law or other applicable law.

SECTION 24 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Weathercraft, its partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and Shopify and its affiliates, will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages of any kind, including loss of profits, loss of revenue, loss of savings, loss of data, replacement costs or similar damages.

This limitation applies whether the claim is based in contract, tort, negligence, strict liability or otherwise, and whether arising from your use of our website, services or products purchased through the website.

Nothing in these Terms excludes, restricts or modifies any liability that cannot be excluded, restricted or modified under Australian Consumer Law or other applicable law.

Where our liability cannot be excluded but may be limited, our liability is limited to the maximum extent permitted by law.

SECTION 25 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless Weathercraft, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities, claims, expenses or legal costs arising out of or related to:

1. your breach of these Terms;
2. your violation of any law or the rights of a third party;
3. your misuse of our website or services;
4. your provision of false, misleading or incomplete information;
5. your breach of liquor licensing requirements; or
6. your supply or attempted supply of alcohol to a person under 18 years of age.

We will notify you of any indemnifiable claim where reasonably practicable. A failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced.

We may control the defence and settlement of any claim at your expense, including the choice of legal representatives, but we will not settle any claim requiring non-monetary obligations from you without your consent, which must not be unreasonably withheld.

You agree to cooperate in the defence of indemnified claims, including by providing relevant documents and information.

SECTION 26 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law.

Any unenforceable portion will be deemed severed from these Terms, and the remaining provisions will continue in full force and effect.

SECTION 27 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules posted by us on our website or in respect of our services, constitute the entire agreement between you and us and govern your use of our website and services.

These Terms supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us, including any prior versions of these Terms.

Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.

SECTION 28 — ASSIGNMENT

You may not delegate, transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent.

Any attempted assignment without our consent will be void.

We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice, including in connection with a business restructure, sale, merger, transfer of assets or change in service providers.

SECTION 29 — GOVERNING LAW

These Terms of Service & Conditions and any separate agreements whereby we provide services or products to you are governed by the laws of Victoria, Australia.

You and Weathercraft submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

You can review the most current version of these Terms at any time on this page.

We reserve the right to update, change or replace any part of these Terms by posting updates and changes to our website.

It is your responsibility to check our website periodically for changes.

Where required by law, we will notify you of material changes to these Terms.

Your continued use of or access to our website or services after any changes are posted constitutes acceptance of those changes.
